Responsibilities:
Provide comprehensive trademark and copyright counselling, including global portfolio maintenance, acquisition and sale of rights, and fair use advice.
Offer advertising clearance and claim substantiation services, ensuring compliance with federal, foreign, and state laws and regulations.
Advise on the validity of claims, strengths of competitive claims, and protections under federal and state statutes, antitrust laws, and the Lanham Act.
Address internet-related trademark and copyright issues, including DMCA safe harbours, anti-piracy measures, ISP liability, social network sites, cybersquatting, and MMOG.
Develop and implement anti-counterfeiting strategies, including internal policies, procedures, draft documents, and collaborate with government agencies.
Conduct product and design clearance for trade dress and product configuration, working with patent colleagues on possible design patent rights.
Review IP portfolios, assess potential liabilities, and devise budget strategies aligned with clients' business objectives.
Qualifications:
Juris Doctor (JD) from an accredited law school.
Active membership in the California State Bar.
Experience in trademark, copyright, and advertising law.
Proven track record in managing and growing IP portfolios for diverse clients.
Strong knowledge of federal and state advertising laws, including the Lanham Act and FTC Act.
Expertise in internet-related IP issues and anti-counterfeiting measures.
