This position supports our medical professional liability line of business. Candidates located within a reasonable commuting distance to Birmingham AL will have a hybrid work arrangement. We can accommodate a fully remote arrangement for qualified candidates located elsewhere in Alabama or other states.


Medical professional liability or general liability coverage experience is strongly preferred.



Job Summary:



The Senior Attorney for the Complex Litigation Team serves as senior legal counsel within the Complex Litigation Team (CLT).


The Senior Attorney will often address the Executive Leadership Team of ProAssurance including the Chief Executive Officer, Chief Financial officer, General Counsel of ProAssurance and the President of ProAssurance's Specialty P&C division. This will include legal analysis and opinion on the Company's large exposure HCPL matters including the Company's HCPL mass tort exposures.



About the Complex Litigation Team:



  • Functions as a boutique law firm that is highly specialized in complex healthcare professional liability for its only client, a large medical professional liability insurance company.

  • Serves as an in-house law firm for the many issues associated with defending med professional liability claims. Examples include complex coverage litigation, bad faith litigation, complex reservation of rights and complex denials of coverage and its associated litigation.

  • Provides immediately available legal counsel to the more than one hundred professionals of the Company's medical malpractice Claim Department.

  • Serves as in-house legal counsel providing extensive legal services to the Company's CXE Department. This includes providing legal opinion and analysis associated with reservation of rights, legal document interpretation, coverage verification and a whole host of constantly arising issues.

  • Provides in-house legal counsel to the Company's HCPL Underwriting Department especially in the dealings with large national brokers, complex policy interpretation and any associated litigation.

  • Manages the many appellate cases resulting from the Company's post-verdict medical malpractice lawsuits.




Essential Duties and Responsibilities:



  • 33% - Provide legal counsel and advice.

  • 33% - Counsel claims staff on legal issues arising during the handling of claims involving National Accounts, SIR Accounts, Mass Torts, tendered defenses and indemnity demands, and responses to personal counsel of insureds.

  • 20% - Manage outside counsel in coverage litigation, including Declaratory Judgment Actions and Arbitration.

  • 10% - Advise Regional Claims Offices and Chief Claims Officer regarding nationwide appellate activity and manage appellate counsel on individual cases where there is an adverse verdict in excess of policy limits and other high-stakes appeals.




Secondary Responsibilities:



  • 4% - Direct and manage claims audits of current insureds and prospective insureds at the direction of Senior Management, Actuary and/or Underwriting.




Qualifications:



  • Juris Doctor required.

  • Licensed to practice law and in good standing in a least one U.S. state or the District of Columbia.

  • Minimum five plus years' experience in medical professional liability claims or a law firm that practices medical professional liability.

  • Strong analytical and legal skills in order to analyze and interpret information. Required.

  • Well-developed research and writing skills. Required.

  • Communicate effectively with Executive Leadership, other departments, insureds, and business partners on legal matters associated with a large national medical professional liability insurance company. Required.

  • Ability to collaborate and act decisively. Required.

  • Proven leadership and strong interpersonal skills. Required.

  • Excellent organizational skills with the ability to manage multiple complex projects simultaneously. Required.

Position Salary Range$83,869.00 - $138,397.00The salary range displayed represents the entirety of the pay grade for this position. Most candidates will start in the bottom half of the range. Factors that may be used to determine your actual salary include your specific skills, how many years of experience you have, your location and comparison to other team members already in this role.
