Job Description:

GENERAL DESCRIPTION OF WORK:

 

Serves as VIA's focal point for acquisition and disposition of VIA's real property interests. May act as the Agency representative, under oath, during direct and cross examination in court cases. Supervises the acquisition and disposition of land for transit facilities and/or other Agency purposes. Ensures that all procurements and agreements are conducted in accordance with applicable local, state and federal regulations. Develops and negotiates lease agreements for use of VIA facilities and/or rental lease agreements for VIA to utilize non-VIA property. Assists leadership in the formulation of the annual departmental budget and the Five-Year Plan.

ESSENTIAL FUNCTIONS:

Responsible for the acquisition and disposition of real property for VIA. Assures that property acquisition and disposition is conducted in compliance with federal, state and local laws of regulations relating to public transportation and real estate, VIA policies and standards, or any other pertinent ordinances or regulations such as public notice announcements, hearings and disposition procedures are adhered to.

Guides the resolution of real property issues for VIA.

Coordinates with inside and outside counsel to manage and oversee legal proceedings for real property acquired under the authority of eminent domain. Testifies at commissioner's hearings and district court cases. Participates in all litigations involving condemnation proceedings. Prepares and/or supervises the preparation of court exhibits, displays, and documents to adequately support VIA's position to acquire property for public use.

Supports other VIA departments as they develop plans and/or projects to assist them in determining potential real property needs and/or alternatives.

Manages property leases and other agreements related to VIA-owned property leased to other entities. Administers all leases, joint property uses agreements and licenses for VIA.

Develops and maintains a comprehensive database of VIA's real property interests.

Formulates scopes of work, estimates budgets, coordinates procurements, monitors and directs consultant contracts for appraisals, surveys, environmental reviews, environmental assessments, environmental impact and compliance activities for land acquisition/real estate.

Conducts research to determine assessed land values for possible acquisition.

Supervises Real Estate staff.

Performs related work as required.

This job description excludes marginal functions that are incidental to performing the job. Other duties may exist.

EDUCATION AND EXPERIENCE:

Bachelor Degree in Business Administration, Urban Planning, Transportation, Engineering, Project Management, or a related field and at least five (5) years’ experience in the disposition/acquisition of real property, facility and capital development management, or project management preferably in transit or development field or an equivalent combination. A Texas Real Estate License and/or Senior Right of Way Agent certification is preferred.

ADDITIONAL REQUIREMENTS:

Must have ability to read and summarize complex materials, such as engineering plans, right of way surveys and appraisal and/or environmental reports.

Must have a good overall understanding of transit programs and operations, including the ability to understand and perform work of a specialized and complex nature.

Must be able to maintain both inside and outside contacts to carry out Agency policies and programs.

Must have ability to deal effectively with individuals at all organizational levels, particularly with individuals of substantially higher rank on matters requiring explanation, persuasion and tact.

Negotiates with developers to assure the most cost-effective joint property use. Prepares joint use agreements.

Must have ability to proficiently use MS Office to include working knowledge of Word, Excel, Access, PowerPoint, Outlook, and Project for property database tracking, Google Earth (kmz) Adobe, and/or ArcGIS, as needed.

Performs related work as required.

Must be self-directed; trustworthy and fiscally responsible to recommend administrative settlement amounts when responding to appeals to VIA's determination of just compensation.

Must have strong negotiating skills.

Must be able to maintain confidentiality of sensitive material.

Must have strong oral and written communication skills, including public speaking.

Must have excellent planning and organizational skills.

Must be able to work from broad policy, analyze conditions and adjust procedures to meet changing circumstances and meet deadlines.

Must have ability to attend meetings and other functions off property.

Ability to gather and analyze complex information and make recommendations.

Requires initiative and independent judgment.

Must be able to maintain good work attendance.

PHYSICAL REQUIREMENTS:

Physical ability of being mobile, bending, stooping, standing, reaching and occasionally lifting objects weighting 5-25 pounds, such as files, supplies and large reference books.

WORK ENVIRONMENTS:

Generally, works within normal office environment.

Work involves deadlines and multiple priorities.

Requires irregular hours, including evenings and weekends.

Some local and out of town travel is necessary.
