ABOUT THE POSITION

Riverside University Health System's Behavioral Health Department is looking for a Senior Deputy Public Guardian to join the team! The incumbent will be responsible for the investigation of financial resources, living situation, and support network of individuals referred to the Public Guardian to determine eligibility for conservatorship. Senior Deputy Guardians will also be tasked with protecting and selling of assets as needed and directed as well as applying for services, arranging transportation, or making court appearances as directed by the court.

Under direction, to perform the more complex estate management work; to manage conservatees; real and personal property; and to do other work as required. Senior Deputy Public Guardian is a single position class located in the Public Guardian office and reports to the Supervising Deputy Public Guardian. This class is distinguished from the Deputy Public Guardian class in that the incumbent manages a small caseload of the more complex conservatorship cases and is responsible for the management of conservatees' real and personal property.

EXAMPLES OF ESSENTIAL DUTIES
• Manages a small case load of the more complex conservatorship cases involving complies appraisals, mismanaged estates, large estates with many sources of income;

• Manages real and personal property to include the security, storage, maintenance, and disposition of property;

• Performs initial and periodic inspections of real property in order to determine and document the property's condition;

Conducts detailed investigations into estates of persons placed under conservatorship to discover and protect assets; locates, marshall, inventories, and take into custody personal property; make preliminary appraisal of assets; take into custody any cash, check or small valuable assets.

• Develops property profiles and conducts title searches; obtains appraisals for insurance purposes;

Coordinates supporting services for assigned caseload including legal, social, medical, and psychiatric services; arranges, in conjunction with social service agencies, for the physical care and shelter of conservatees

• Arranges for and maintains fire, liability, mortgage, and vandalism insurance; Arranges for the sale of real property through local real estate broker listings and public auctions for the sale of personal property;

• Arrange for the burial of conservatees and the distribution of assets pursuant to testate or intestate succession; arranges for the adoption or disposal of pets.

• Posts legal notices and advertisements; informs prospective buyers of the conditions of sale, bidding, and payment;

• Determines whether vacant property should be rented or leased and appropriate rent to be charged; insures that the property is cleaned and repaired before renting; advises tenant of move-in date and collects deposits and initial rent payments.

• Evaluates the real property of new conservatee cases and reviews existing rental or lease agreements;

• Monitors the contract Property Management Services to assure that property is maintained and rented and advises other Public Guardian staff of recommended actions to protect property;

• Makes court appearances and may testify at hearings concerning conservatees.

• Files small claims actions and presents case on behalf of the conservatee; testifies in court regarding the Public Guardian Office's actions involving real property; appears in court for the confirmation of sale of real property.

MINIMUM QUALIFICATIONS
Knowledge of: The Public Guardian/Conservator's function and related laws, regulations, and codes; Practices and methods used in financial and estate investigations to determine assets including real and personal property; Real property management; real estate principles and practices including title vesting, financing, selling costs, deeds, contracts, and appraisal techniques; Vehicle and mobile home sales and title transfers; escrow procedures and title documents; Banking and other financial procedures.

Ability to: Manage and protect the assets of wards and conservatees; Interpret and apply laws and regulations related to Public Guardian and Conservator's work; establish and maintain effective working relationships with governmental agencies providing supporting services to wards and conservatees and with others contacted in the course of the work; Monitor contracts for professional services; Interview effectively; Establish and maintain accurate financial and casework records; Make effective presentations in court; Learn landlord/tenant laws; Work closely with disabled and disoriented persons.

Experience: Some experience managing the financial and social affairs of persons placed under guardianship or conservatorship by the court or administering the estate of decedents. This experience must have included:

Detailed investigations into estates of conservatees or of the deceased in order to discover and protect assets

AND

Assisting in the disposal of estate real and personal property, either through sales, public auction, or disbursement to heirs.

MISCELLANEOUS RETIREMENT: County of Riverside has three retirement Tiers through the California Public Employees' Retirement System (CalPERS).



  • Tier I (Classic Member - Formula 3% @ 60): Applicable to current and former County of Riverside local miscellaneous employees hired prior to 08/24/2012 and did not withdraw CalPERS contributions. The employee contribution is eight (8%) percent.


  • Tier II (Classic Member - Formula 2% @ 60): Applicable to local miscellaneous employees 1) hired after 08/23/2012 through 12/31/2012; 2) Previously employed with another CalPERS contracting public agency or a reciprocal retirement system, with a break in service of less than six months between the separation date with the previous employer and the appointment date with the County of Riverside. The employee contribution is seven (7%) percent.


  • Tier III (PEPRA New Member - Formula 2% @ 62): Applicable to CalPERS local miscellaneous new members hired on or after the implementation of the Public Employees' Pension Reform Act of 2013 (PEPRA) which took effect January 1, 2013. Effective July 1, 2023 employee contributions are 7.25% and will increase to 7.75% effective July 1, 2024.


A new member is defined as any of the following:
  • A new hire who enters CalPERS membership for the first time on or after January 1, 2013, and who has no prior membership in any California Public Retirement System.
  • A new hire who enters CalPERS membership for the first time on or after January 1, 2013, and who was a member with another California Public Retirement System prior to that date, but who is not subject to reciprocity upon joining CalPERS.
  • A member who first established CalPERS membership prior to January 1, 2013, and who is rehired by a different CalPERS agency after a break in service of greater than six (6) months.

  • CalPERS refers to all members that do not fit within the definition of a new member as "classic members".

    Contribution rates are subject to change based on the County of Riverside annual actuarial valuation.

    DEFERRED COMPENSATION: Voluntary employee contribution with a choice between two 457 deferred compensation plan options.

    VACATION ACCRUAL (Bi-Weekly Accrual):

    0< 3 year = 80 Hours (10 Days)
    4< 9 years = 120 Hours (15 Days)
    10 or more years = 160 Hours (20 Days)

    Maximum Vacation leave accumulation is 480 hours.

    SICK LEAVE: Four (4) hours Sick Leave accrual per pay period with unlimited accrual.

    HOLIDAYS: Normally 12 paid holidays per year

    BEREAVEMENT LEAVE: Allowed 5 days (3 days are County paid; 2 additional days can be taken from accrued Sick Leave balance)

    BASIC LIFE INSURANCE: Equal to one times annual base salary not to exceed $50,000 of term life coverage. Premiums are paid by the County. Additional Supplemental Life plan is available for employee purchase.

    DISABILITY: Short-term Disability benefit pays up to a maximum of $461.54 weekly, payable up to a maximum of 52 weeks.

    POST RETIREMENT MEDICAL CONTRIBUTION: A monthly contribution is made by the County towards retiree health insurance offered through the County as governed by the applicable Memorandum of Understanding.
